Right of revocation

For party to a contract as consumer in the sense of § 13 BGB apply to:

If you act as a consumer, you can cancel your contract within 14 days without giving reasons in text form (letter, email) or- if the goods remain before the deadline expires- by returning the goods revoke. The revocation period commences the day following the receipt of merchandise and this revocation instruction in text form (in case of recurring deliveries of similar goods not before arrival of the first part delivery and also not before fulfilment of our information obligations pursuant to Article 246 § 2 in conjunction with § 1 Abs. 1 and 2 EGBGB). To meet the revocation period term the timely dispatch of the declaration of  revocation or the return shipment.

In case of a valid revocation, all mutually received performances as well as emoluments taken (e.g interest) if applicable, are to be restituted by either side. If you can return the received goods and utilization not or partly or only in deteriorated condition, then you have to insofar compensate for its value where applicable. For deterioration of the goods and derived benefits you must pay compensation only, where the use or the deterioration is due to a deal of the matter, beyond the examination of the characteristics and functioning. Under testing the properties and functioning refers to testing and trying out the goods, as for instance in a retail store or putting the merchandise to its intended use. Things that can be shipped by parcel are to be returned on our risk. You have to bear the cost of return shipping, if the delivered things correspond to the ordered and if the price of the merchandise to be sent back does not exceed an  amount of  € 40  or if you have not yet at the time of revocation provided the consideration or a contractually agreed part  payment at a higher price. In all other cases, the return shipment is free of charge. Things that cannot be shipped by parcel will be picked up. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the things, for us within its receipt.
